FlightPath additional terms
accept when you create your account and which apply to everything you do on the platform. They apply when you use FlightPath (also called Mission Control). The Terms of Use continue to apply in full, including the sections on your account, acceptable use, patient and clinical information, our liability and the law that applies. Where these terms say something more specific about FlightPath, they add to the Terms of Use; they do not replace them, and where the two conflict the Terms of Use take precedence.
You will be asked to accept these terms, and to read the FlightPath privacy information, before you first use FlightPath. If you do not agree, please do not use FlightPath.
1. What FlightPath is, and who can use it
FlightPath is a free regulatory pathway mapping tool. It helps medical device and health software innovators, and teams planning clinical trials of investigational medicinal products (CTIMPs), see the steps usually needed for the NHS and UK regulation, across commercial, technical and regulatory frameworks.
FlightPath is available to platform members we give access to. During the beta it is available only to invited testers. We may invite you to use it by email; if you do not yet have an account, you create one when you accept the invitation. We may change who can use FlightPath at any time.
2. Not legal, regulatory or clinical advice
FlightPath provides general information and planning support only. It does not give legal, regulatory, clinical or commercial advice, and it does not assess, certify or approve anything. It is not a substitute for advice from qualified professionals (see section 17 of the Terms of Use). Regulations change and can apply differently to your circumstances. Always confirm your pathway and obligations with the relevant body (for example the MHRA, the HRA, or your sponsoring NHS organisation) before making submissions or commercial decisions.
FlightPath links to, and summarises, public guidance from bodies such as the MHRA, the HRA and NHS England. That guidance belongs to them, and FlightPath is not endorsed by them.
3. Using FlightPath
You may use FlightPath for your own, or your organisation's, innovation and trial planning. In addition to section 6 of the Terms of Use (acceptable use), you must not:
-
use FlightPath to provide services to third parties without our written agreement;
-
copy, reverse engineer or redistribute any part of FlightPath, its regulatory frameworks or its pathway logic;
-
enter information about patients or other identifiable people, for example in a problem statement. FlightPath does not need it, and section 8 of the Terms of Use (patient and clinical information) applies.
4. FlightPath's content, and yours
FlightPath's software, data structures, design, regulatory frameworks and pathway logic belong to us or our licensors. Nothing in these terms gives you any right in them beyond using FlightPath as described here.
You keep ownership of the missions you create. We store them so that you can come back to them, as the FlightPath privacy information describes. We do not publish them or show them to other members, and we use them only to provide FlightPath to you and, if you choose to share your progress, as that consent describes.
5. Your missions, and keeping copies
You can download or delete your FlightPath data at any time in FlightPath Settings. Please keep your own copies of anything important. We delete FlightPath data that has not been used for 2 years, and we do not guarantee that FlightPath will always be available.
6. Beta, availability and changes
FlightPath is at an early (beta) stage and may change. We may update, suspend or withdraw FlightPath, or your access to it, as sections 2, 13 and 14 of the Terms of Use allow, for example at the end of the beta test. We will try to give you notice so you can download your data first.
7. Our responsibility
Section 15 of the Terms of Use (our liability) applies to FlightPath. In addition, because FlightPath is a free planning tool, we are not responsible for decisions made by you or by any other organisation based on a pathway FlightPath suggests, including regulatory delays or the outcome of any submission. Nothing in these terms limits our liability where the law does not allow it to be limited.
8. Changes to these terms
We may update these terms, for example to reflect changes to FlightPath or the law. If a change is significant, we will ask you to accept the new version before you next use FlightPath.
